Serving United States clients from the UK

We are a UK company working remotely for US clients, quoted in USD and scheduled around your time zone. This page covers the parts that genuinely differ from working with a UK supplier: US privacy law, sales tax rather than VAT, and the accessibility standard your buyers will actually ask about.

There is no single US privacy law, and pretending otherwise is a risk

The United States has no comprehensive federal privacy law for private-sector data. Instead there is the California Consumer Privacy Act as amended by the CPRA, plus a state patchwork that has grown every year - Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky and Rhode Island among them, with more added regularly.

These laws differ in what they require and in the thresholds that trigger them, so 'are we compliant' is a per-state question rather than a single answer. We handle this by scoping to the strictest regime that actually applies to the data we process, so a change of state does not become a rebuild.

Two US rules are worth calling out because they catch people out. Illinois' Biometric Information Privacy Act is a consent regime for face and voice data that imposes statutory damages per violation. Washington's My Health My Data Act applies to consumer health data even when you are not a healthcare business. If either is in scope, it changes what the project is, and we will say so before quoting.

  • Data processing terms covering the CCPA/CPRA rights: access, deletion, correction, portability, opt-out of sale or sharing
  • A sale/sharing assessment - the 'sale' and 'sharing' definitions catch data flows people do not realise qualify
  • No US personal data leaves your agreed environment except as we document
  • Notice and consent mechanisms built into the product where the law requires them, not just a banner

Sales tax, invoicing and US tax forms

US sales tax is not VAT. There is no single national rate, nexus rules determine whether you owe it, and it is assessed at checkout rather than invoiced by us - so what we do and do not charge is genuinely different from a UK engagement.

We invoice in USD and you will need one of the standard US tax forms before we can invoice: Form W-9 for a US business, or W-8BEN-E for a non-US entity claiming treaty benefits. Send whichever applies during scoping. UK supplier withholding on cross-border services is a matter for your own advisers, but it is exactly the kind of thing that stalls an accounts-payable process, so we will send the forms early.

  • USD invoicing, converted at the rate on the day of invoice
  • Form W-9 or W-8BEN-E requested during scoping, not at first invoice
  • We do not charge US sales tax - your checkout process handles that
  • ACH or bank transfer, invoice to your AP address rather than an individual

ADA, Section 508 and WCAG 2.2 AA

The Americans with Disabilities Act and Section 508 are the US frameworks, but they do not specify a technical standard. In practice WCAG 2.2 AA is what US accessibility requirements resolve to, and Section 508 aligns to WCAG 2.0 AA with additional requirements for federal procurement.

For a consumer product, the ADA exposure is litigation risk, and the most common findings in actual cases are keyboard traps, missing accessible names, poor colour contrast and forms that do not report errors to assistive technology. We test with a keyboard and a screen reader as part of delivery rather than producing a conformance statement nobody has checked.
